Terms of Use

1. Purpose and scope

These Terms set out the conditions under which EURL iTAXI makes the itaxi.dz website available to you and the rules you agree to follow when using it.

Use of the “iTAXI” and “iTAXI PRO” mobile apps may be subject to specific terms accepted within the apps. In the event of any conflict, those specific terms prevail for the service concerned.

2. Publisher

The website is published by EURL iTAXI, a single-member limited liability company whose registered office is located at Ali Mendjeli, Cité 352 logements, Building Y05, Unit 19, El Khroub, 25100 Constantine, Algeria, registered with the trade register under no. 24B0074783 - 00/25, NIF 002425007478387, NIS 002425060046846.

3. Definitions

For the purposes of these Terms, the following terms have the meanings below:

• “Website”: the website available at itaxi.dz.
• “Apps”: the “iTAXI” app for passengers and the “iTAXI PRO” app for drivers.
• “User”: any person who accesses the Website.
• “Applicant”: any person who submits an application to become a partner driver.
• “Partner driver”: any driver whose application has been accepted and who uses the “iTAXI PRO” app.

4. Description of the services

iTAXI provides a service connecting passengers and drivers through its Apps. The Website presents this service and allows drivers to submit their applications.

As of the date these Terms were last updated, the service is available in the wilayas of Constantine, Algiers, Blida and Boumerdès. In the wilaya of Sétif, driver registrations are open and the service will launch soon. The list of areas served may change.

5. Access to the Website

The Website is available free of charge, except for internet connection costs, which remain your responsibility. EURL iTAXI endeavours to keep the Website continuously available but cannot guarantee it.

Access may be suspended, in particular for maintenance, updates or security reasons, without giving rise to any right to compensation.

6. Driver applications

To submit an application, you enter your first name, last name, phone number and city, then send the required documents through the online form.

You warrant that the information and documents you provide are accurate, up to date and your own. Any false statement or forged document will result in the application being rejected, without prejudice to any legal proceedings.

Each application is reviewed by the EURL iTAXI team. Submitting an application does not mean it is accepted. EURL iTAXI reserves the right to accept or reject an application based on safety and service-quality criteria. The account of an accepted applicant is activated within a maximum of four (4) days after a complete application is received; EURL iTAXI contacts them by phone.

The documents and information to be provided are:

• driving licence;
• vehicle registration certificate (carte grise);
• profile photo;
• a photo of the front of the vehicle;
• where applicable, a power of attorney if the vehicle is not in the applicant’s name.

7. Partner driver subscription and trip pricing

Partner drivers access the “iTAXI PRO” app in return for a monthly subscription paid in Algerian dinars (DA) to EURL iTAXI. The subscription amount and payment terms are communicated to the driver before any subscription is taken out.

EURL iTAXI takes no commission on trips (0% commission).

The fare for a trip is calculated based on the distance travelled (in kilometres) and the trip duration (in minutes), according to the rates displayed in the Apps. A fixed service fee, paid by the rider, is added to the fare. Each ride has a minimum price per city, service fee included (for example 300 DA in Algiers and 250 DA in Constantine).

Where services are offered or paid for electronically, the provisions of Law No. 18-05 of 10 May 2018 on electronic commerce apply.

7a. iTAXI Wallet and online payment

The iTAXI Wallet is a prepaid balance in Algerian dinars linked to a rider's or partner driver's account. It can be topped up on the Website with a CIB or Edahabia card.

Payment is processed on SATIM's secure page; EURL iTAXI neither collects nor stores card data. Every top-up has a reference and a receipt.

A top-up is between 200 DA and 50,000 DA. The balance is credited once the payment is confirmed; a confirmed payment that cannot be credited is refunded.

Riders may use the balance to pay for rides. For partner drivers, the monthly subscription and the service fees of rides paid in cash are deducted from the balance.

A partner driver's subscription is valid for one month from the date it is paid.

The wallet balance, for riders and drivers alike, does not expire. Unused balance can be refunded on request to our customer service.

For any refund request or complaint about a payment, contact us at support@itaxi.dz or on 0982 30 13 57, every day from 9:00 to 21:00, quoting the receipt reference (WLT-…).

8. User obligations

By using the Website, you agree to:

• comply with applicable Algerian laws and regulations;
• provide only accurate information and authentic documents;
• not impersonate any third party or use another person’s phone number;
• not interfere with the operation, security or integrity of the Website;
• not use automated means to access the Website or collect data from it.

9. Security and abuse prevention

To protect the Website and its Users, EURL iTAXI applies abuse-prevention measures, including an anti-bot service and limits on the number of requests and verification attempts.

EURL iTAXI may temporarily or permanently block access to the Website or to a feature in the event of abusive or fraudulent use or use contrary to these Terms.

10. Intellectual property

The Website and all its elements (texts, the “iTAXI” and “iTAXI PRO” trademarks, logos, illustrations, graphics, software) are the property of EURL iTAXI or are used under licence. Any full or partial reproduction, display or adaptation without prior written authorisation is prohibited.

11. Liability

EURL iTAXI uses reasonable efforts to provide accurate and up-to-date information, without guaranteeing the absence of errors or omissions. It shall not be liable for any interruption of the Website, any malfunction of the network or of the User’s equipment, or any use of the Website that does not comply with these Terms.

Nothing in these Terms excludes any liability that cannot be excluded under Algerian law.

12. Personal data

Personal data collected on the Website is processed in accordance with Law No. 18-07 of 10 June 2018 on the protection of natural persons with regard to the processing of personal data. How your data is processed and your rights are described in the Privacy Policy.

13. Changes to the Terms

EURL iTAXI may amend these Terms at any time. The applicable version is the one published on the Website on the date of your use. The date of the last update appears at the top of this document.

14. Governing law and jurisdiction

These Terms are governed by Algerian law. In the event of a dispute, the parties will first seek an amicable solution. Failing that, the dispute will be brought before the competent courts of Constantine.
